Trust decanting is the process of transferring assets from one trust (the “original trust”) to a new or existing trust (the “second trust”) with modified terms that better serve the interests of the beneficiaries. Under the California Trust Decanting Act, trustees can decant a trust without court approval or beneficiary consent, as long as the action aligns with their fiduciary duty and applicable state laws.
